Dear Sir or Madam:


At or around 12:30 today I was working at my job as a personal Care Assistant for The Cornerstone Foundation In their Day Service Facility( this is the place where all the special needs clients stay for the day and have classes and activities).   Lunch had been served and I was I was waiting to go on what they call the work program which consists of supervising the higher functioning residents as they work on the owners ranch or take care of  the residential homes owned by the foundation.  There are no scheduled breaks or lunches at the facility and it is up to the staff to provide themselves break time during the day during slow periods.  I had just finished lunch while helping the other staff supervise the meals.  I then took the time to go outside to have a break.  As staff is required to be in the smoking room when residents are present I took it upon my self to watch the unsupervised residents that I found in the break room.  I remember that one resident whose name was Jeanne was causing a commotion by saying unpleasant things to another resident whose name is George.  Since I had worked at this facility I had found that Jeanne had a very labile mood.  She would often make very derogatory remarks to both patients and staff.  These remarks were often ignored by the staff and this action would either spur her one to make more cutting remarks or to be quiet.  As I could never determine the cause of her agitation I chose to ignore her remarks.   She did however escalate in my case by physically striking me and pulling my hair on more than one occasion.  In the Smoking room I did notice that Jeanne and George were agitated and arguing about something.  I assumed that Jeanne had said something that annoyed George and George was trying to defuse the situation as best he could.  Since this is a common occurrence I was not paying particular attention to their argument as I was talking to another client named Jackson.  I heard one person who I am not sure was staff or another client tell George that you’re better off ignoring her.  This is the last thing I remember of the incident.  A bit later a staff member named Penny came into the room and asked me and George to come with her.  We were led into the office that is used by Tish and Rick.  Rick and Tish and I believe Penny and a blonde haired lady who is newly designated director of the residential program were in the room.  Jim Starr had and a resident had been asked to leave.  The door was shut and Rick asked us who wanted to start.  I had no knowledge of what he was talking about so I remained silent. George also remained silent.  Rick then directed his attention to George and asked him why he told Jeanne to suck his big fat dick.  Rick did not what for a reply and asked what he thought his punishment should be.  George said that he could forgo outings but Rick said that wasn’t enough and he warned George that if he did not come up with a suitably harsh punishment for himself that he would regret it.  George then offered to quit smoking for one and then two weeks which Rick then accepted.  Rick went on to say that he had been warned on numerous occasions that he could not swear and that he would have to sit with Rick in his office during breaks.  He told George that if it happened again he would take away his holiday visits to his family and have him spend Christmas with him.  Rick then dismissed George and turned his attention to me.  He told me that another staff had heard me laugh at Georges comment to Jeanne and asked me what I had to say for my self.  I said I didn’t remember him saying that.  He said that I must have remembered since it had happened within the last five minutes.  I said I was sorry but I didn’t remember the incident.  He stated that I must be either dumb or lying.  At this point I found my self wondering why this man was so angry with me.  He then asked me if he gave me a paycheck each week for working there.  I said yes he did. He said that I was fucking working for him and that meant I needed to supervise the residents.  I stated that I didn’t think it was appropriate for him to talk to me in that manner and asked if he wanted to fire me.  He told me that that would be too good for me since I could then get unemployment insurance.  He then threatened to find some other way to fire me without having to pay me unemployment insurance.  As my knowledge of the unemployment insurance laws of this state are vague at best I did not know what he was specifically talking about.  I do know that I had been working there for almost a year and had been never written up and had a very good attendance record  along  with a good review he had no common ground to fire me.  I therefore felt threatened and when he asked if I had anything more to say I said I resign and walked out.
